OMMA Certificate of Compliance Process Approved

Oklahoma Medical Marijuana Authority Certificates of Compliance were widely discussed at Tuesday morning’s meeting of the Washington County Commissioners.

Chairman Mitch Antle said the County will begin receiving these forms from the OMMA who has broken down the mechanisms, by which medical marijuana is produced to be between growers, processers and dispensaries. He said each licensee will now be required to remit to their local governing authority this certificate of compliance for the next iteration of their license.

The problem is that there are check boxes the County is to sign off on. There are 6 boxes for the County to check off, but only two are applicable to the governing body.

Chairman Antle recommended that the OMMA compliance forms be sent to the Assessor’s Office to cover the bases before it is added as a new business item on the next agenda for the Commissioners. The Assessor's Office will help identify where the property is located to make sure it is within the County's jurisdiction. Then a property record card for the people looking for a license and the OMMA form will be sent to the Commissioners' Assistant Melody Johnson.

This is meant to be a clean process. Chairman Antle said that that should be the most efficient way for them to handle this situation with the OMMA compliance forms moving forward. He said it insures that they have collected or identified the business for business personal property reasons.

Compliance indicates that the County has some liability to inspect the facilities where medical marijuana is grown, processed or dispersed. However, Chairman Antle said they have no obligation to inspect them because they are not the licensing authority.

The Oklahoma State Department of Health is the licensing authority. Every County in the State of Oklahoma has an inspector whether they have a health department or not that inspects for compliance. The compliance portion of the OMMA certificate is simply saying the proposed uses of medical marijuana satisfy the political subdivisions, applicable zoning, classification and ordinances.

The process was approved.
